• Marketing Communications: To send promotional offers, bonuses, and platform updates to Players who have provided marketing consent. You may withdraw marketing consent at any time via your account settings.

Under the Data Privacy Act of 2012, 5bmw3 processes your personal data on the following legal bases:

5bmw3 uses cookies and similar tracking technologies to deliver and improve the Platform. The following types of cookies may be placed on your device when you access 5bmw3:

Parents and guardians who have reason to believe that an underage individual has registered on 5bmw3 should contact the 5bmw3 support team or Data Privacy Officer immediately at the contact details provided in Section 15. 5bmw3 treats underage access reports as urgent matters and commits to acting within 24 hours of notification.

Where personal data is transferred to recipients located outside the Philippines — for example, in connection with cloud hosting infrastructure, game provider technical systems, or cybersecurity services — 5bmw3 ensures that such transfers are carried out in compliance with Section 21 of the Data Privacy Act of 2012 and NPC guidelines on cross-border data transfers.

Specifically, 5bmw3 ensures that any recipient of personal data outside the Philippines:

• Is subject to data protection laws of a country providing a comparable level of protection to that afforded by RA 10173; or
• Has entered into a data transfer agreement or binding corporate rules that impose equivalent obligations on the recipient as those applicable to 5bmw3 under Philippine law; or
• Has otherwise demonstrated to the satisfaction of 5bmw3 that adequate safeguards are in place for the protection of transferred data.

Transfers of personal data for mandatory PAGCOR or AMLC regulatory reporting purposes are exempt from the above requirements to the extent required by Philippine law.

5bmw3 reserves the right to amend, update, or replace this Privacy Policy at any time to reflect changes in applicable Philippine law, NPC guidelines, PAGCOR regulations, or 5bmw3's data processing practices.

Where amendments are material — meaning they significantly affect your rights as a data subject or change the purposes for which your data is processed — 5bmw3 will provide advance notice to affected Players via the mobile number or email address registered to their account, no less than fourteen (14) days prior to the amendment taking effect.

For non-material amendments (e.g., clarifications, formatting updates, contact detail changes), the updated Policy will be published at 5bmw3.co/privacy-policy with an updated effective date. Continued use of the 5bmw3 Platform following any amendment constitutes your acknowledgment of the revised Policy.
